Upptimely AB (Upptimely) is both a controller and a processor. We are a data processor when it comes to the processing of our customers´ Contacts’ personal data. As our customer is the data controller, we will only process the data in accordance with their instructions. However, we will ensure that it is properly protected all the time. For more information about this see the section about Data Security below.
When it comes to the processing of User’s personal data, we are the data controller and as the data controller Upptimely works to ensure your privacy is protected when using our services. We will therefore in this Notice explain how your personal data will be processed and protected.
Upptimely respects your integrity and you right to control your own personal data. Our guided principles are simple. We will be open and transparent with the data we collect and why. We will furthermore do everything in our power to protect your data
In Upptimely’s Privacy Notice we will inform you what kind of information we collect from and about you, for what purpose the information is being collected and in what way you can keep control over your own data and, obviously, how to contact us. This Privacy Notice applies when using webpages and services that are offered by Upptimely.
Upptimely is responsible for the personal data that is collected in accordance with these terms and is responsible for processing according with applicable data protection legislation, which also includes, the EU General Data Protection Regulation (GDPR) and any subsequent legislation replacing or supplementing the above.
Upptimely collects data if you are a customer or if you sign up to our communication channel. Our definition of a communication channel is when you are asked to fill in your contact details. Examples of personal data we collect is your name, contact details i.e. name, email address and mobile number. Job title and avatar if it has been entered into the system.
We may collect information in connection with:
a) When you sign up to use our app.
b) Notification of a service offered by us.
c) When you enter your e-mail address or your mobile phone number on our website.
d) If you contact us via email, by phone or our website.
Upptimely processes personal information mainly for the purposes stated below:
a) To fulfill orders for services offered by Upptimely;
b) Ensure good customer service, for instance managing your requests, correcting incorrect information or sending information you requested e.g. our newsletter;
c) To develop, deliver and improve our product and services through analysis of your behavior on our website.
d) To be able to contact you via email or post about services that we believe may be of interest to you. Please note that you may decline this promotion at any time; or
e) To be able to send important messages as communication about changes in our terms and policies.
We may share information with other companies that process data on our behalf in order to perform our services, for example analysis. However, all handling of personal data always ensures high security and confidentiality.
The company only collaborates with partners handling personal data within the EU/EEA or with companies that maintain the same level of protection as in the EU/EEA by, for example, by signing EU Standard Contractual Clauses.
The infrastructure of our Email services provider, both incoming and outgoing from the app is based in the USA. We have an agreement with this provider, ensuring that they meet the standards required for the protection of privacy data, and will delete data on our request if a user or contact should claim that right.
Upptimely reserve the right to transfer any personal data we hold about you in the event that we merge with or are acquired by a third party or become the subject of any other business transaction such as a reorganization, or if any such transaction is proposed.
By submitting information to Upptimely, you allow us to register and processing the personal data for the specified purposes. As a legal basis for this processing, Upptimely will refer to compliance with contract, legal obligation or legitimate interest. If we use legitimate interest as a basis, it will only be done for the purposes stated above.
The processing will be done in accordance with GDPR and means your personal data is not retained for a longer period than necessary for the purpose of the processing. Upptimely will store your personal information as long as you are a customer with us. Most personal data will be erased at the most 12 months after you have ceased being a customer of ours for analysis or direct marketing purposes, or when you unsubscribe to newsletters. Some information may be retained longer when required due to other legal requirements, such as the accounting law. However, all handling of personal data always ensures high security and confidentiality.
Upptimely use persistent first-party cookies to store certain preferences and to make it easier for you to use our application. A cookie is a piece of text stored by your browser to help it remember your login information, site preferences, and more.
We also use Google Analytics to learn more about the usage of our app and website, but you need not worry as we have ensured that Google does not collect information in such a way as they can identify you as a person.
All personal data, other data that is entered into the app, documents and backups are only ever stored within the EU. The current locations are Dublin, Frankfurt and Stockholm. The personal data and other data is stored in highly secure data centers, hosted by companies such as Amazon Web Services and Linode. The data centres we use demonstrate ongoing compliance with rigorous international standards, such as ISO 27017 for cloud security, ISO 27018 for cloud privacy, SOC 1, SOC 2, and SOC 3, PCI DSS Level 1, and more.
In order to protect all personal data and other data from unlawful and unwanted disclosure, it is encrypted via SSL between the customer browser and our servers. The personal data and other data is backed up twice daily and stored in multiple locations. The app is run on the cloud application platform Heroku, owned by Salesforce, their approach to security management can be read here.
You have rights when it comes to your personal data, and you are able to control your information and what information is being stored by us. We will, on our own or your initiative, rectify data that is found to be incorrect. You can also at any time request to have your personal data deleted or object to its use by contacting us (for contact see the heading "How to contact us"). If you believe that we do not respect your rights, please contact us or you can contact your local Data Protection Authority.
You can at any time refrain from receiving marketing communications from us by emailing our support and "unsubscribe" from the email and SMS communications that we send you.
Finally, you have the right to receive information about what personal data Upptimely have stored about you. In order to this, please contact us via the contact information you find below.
Without limiting your rights as a consumer under the laws of your country, The Privacy Notice, as well as all disputes or claims arising in connection with The Privacy Notice, shall be governed by the laws of Sweden. Disputes arising in connection with the Privacy Notice or use of the Website shall be subject to the exclusive jurisdiction of the Swedish courts.
